July 28, 2020 Opinion or Order Filing 71 DEFAULT JUDGMENT: NOW, on the motion of Virginia & Ambinder, LLP, attorneys for Plaintiffs, it is hereby: ORDERED AND ADJUDICATED that Plaintiffs do recover of Shorecon, the Defendant, with its principal place of business, upon information and bel ief, located at 2608-2610, Route 88, East Suite 4, Point Pleasant New Jersey 08742 in the amount of $48,637.64, consisting of amounts owed in connection with Shorecon's work on the Build It Back Brooklyn project as follows: (1) the liqui dated damages of $6,031.83, (2) the audit costs of $3,400, (3) attorneys' fees and costs of $39,205.81; (4) post judgment interest at the statutory rate; and (5) such further legal, equitable, or other relief as the court sees just and proper; and, that the plaintiffs have execution therefore. July 13, 2020 Opinion or Order Filing 69 MEMORANDUM OPINION AND ORDER re: 53 MOTION for Default Judgment as to Shorecon-NY, Inc.: For the foregoing reasons, Plaintiffs' motion for default judgment is granted. As to damages, Plaintiffs' request for $6,031.83 in liquidated damages, $3,400 in audit costs, $697.30 in costs incurred in litigating this action, as well as post-judgment interest, are granted. Although Plaintiffs are also entitled to attorneys' fees incurred in bringing this action, that amount is modified based on the marginally reduced rates discussed above. No later than July 27, 2020, Plaintiff shall submit a revised request for attorneys' fees. With those papers, Plaintiffs shall submit a revised proposed order for default judgment. After the Court receives and reviews those papers, it will direct the Clerk of Court to enter a default judgment and close this case. (Signed by Judge Ronnie Abrams on 7/13/2020) (jwh)
February 27, 2020 Opinion or Order Filing 52 ORDER: On January 21, 2020, Plaintiffs requested a certificate of default against Defendant Shorecon-NY, Inc. from the Clerk of Court. Dkt. 49. On January 22, the Clerk of Court entered the certificate of default. Dkt. 51. Plaintiffs, however, have n ot filed a motion for default judgment pursuant to Federal Rule of Civil Procedure 55(b)(2) and Local Civil Rule 55.2(b). If Plaintiffs still intend to seek a default judgment against Defendant Shorecon-NY, Inc., Plaintiffs must do so in accordance with this Court's individual rules, as provided in Attached A, no later than March 10, 2020.
