Filing 69 OPINION & ORDER re: 51 MOTION for Summary Judgment . filed by Cynthia Braun, City of New York. For the foregoing reasons, Defendants' motion for summary judgment dismissing the claims against the City and Brann is GRANTED. De fendants' motion for summary judgment dismissing the entirety of the Complaint is DENIED to the extent in could be read to seek dismissal as to the John Doe Correction Officers. Plaintiff is directed to submit a letter, affidavit, or memorandu m, within forty-five (45) days of this Opinion & Order, explaining why this action should not be dismissed against the John Doe Defendants for failure to prosecute. His submission should (1) detail any efforts to date to identify the Doe Defendan ts and (2) address why his claims would survive summary judgment. The Clerk of Court is directed to mail a copy of this Opinion & Order to the pro se Plaintiff. SO ORDERED. Filing 65 ORDER: Accordingly, in light of the fact that Plaintiff is incarcerated and proceeding pro se, it is hereby: ORDERED that Plaintiff's deadline to oppose Defendants' motion for summary judgment is extended nunc pro tunc to December 30, 20 19, and his submission is accepted as timely.
