March 27, 2023 Opinion or Order Filing 322 FINAL JUDGMENT: The Court, having been informed that the parties have reached an agreement, hereby enters judgment as follows: IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED that CapLOC, LLC have and recover from Ron McCord and First Mortgage Company , LLC,jointly and severally, the sum of Thirty-One Million Dollars and Zero Cents ($31,000,000.00), plus interest accruing from the date of this Final Judgment until payment in full in the amount of 4.26% per annum. IT IS FURTHER ORDERED, A DJUDGED and DECREED that CapLOC, LLC is allowed all such writs and process as may be necessary in the enforcement and collection of this Final Judgment. IT IS FURTHER ORDERED, ADJUDGED, and DECREED that all claims asserted or that could have been ass erted by First Mortgage Company, LLC against Eli Global, LLC in this lawsuit are dismissed with prejudice to refiling of the same. IT IS FURTHER ORDERED, ADJUDGED, and DECREED that this Final Judgment is afinal judgment and it fully disposes of all claims between all parties in this action., First Mortgage Company, LLC and Ron McCord terminated. November 23, 2021 Opinion or Order Filing 288 ORDER: The ongoing COVID-19 pandemic has necessitated substantial changes in the Court's trial schedule in order to ensure that jury trials can be conducted safely and practically. Accordingly, the trial scheduled to commence on June 1, 2022, is ADJOURNED. The Court, utilizing the procedures within this District governing the scheduling of jury trials during the COVID-19 pandemic, will seek to schedule a jury trial for the third calendar quarter of 2022. By April 15, 2022, the parties sha ll submit blackout dates for trial for both the third and fourth calendar quarters of 2022. The final pre-trial conference set for May 25, 2022, is ADJOURNED sine die. The Court will schedule the final pre-trial conference upon setting a date certain for trial. By May 15, 2022, the parties shall submit a joint letter summarizing any necessary alterations to the pretrial order, ECF No. 283, and any other matters that should be brought to the Court's attention in advance of trial in light of the revised schedule. March 18, 2019 Opinion or Order Filing 226 ORDER denying 212 Motion for Reconsideration. On August 29, 2018, Plaintiff moved for reconsideration of the Court's decision denying injunctive relief, or, in the alternative, to appoint a receiver over Defendant. (As further set forth in this Order.) For the reasons stated above, Plaintiff's motion for reconsideration is DENIED in its entirety.
