August 9, 2018 Opinion or Order Filing 29 OPINION AND ORDER re: 21 MOTION to Dismiss for Lack of Jurisdiction and failure to state a claim upon which relief may be granted. filed by Joseph Criag Blockno, Charles Christopher Remke, Mark Line Industries, LLC. For the foreg oing reasons, Plaintiff's motion to dismiss is GRANTED IN PART and DENIED IN PART. In particular, Plaintiff's claims for breach of contract, alter ego liability, promissory estoppel, breach of fiduciary duty, conversion, and violations of D CL §§ 273, 274, and 275 survive. Moving Defendants are ORDERED to file an answer or otherwise respond to the Amended Complaint within 21 days of the date of this Order. Within 14 days thereafter, the parties shall submit a joint status lett er and a proposed Civil Case Management Plan, as outlined in the Notice of Initial Pretrial Conference in this matter. (Dkt. #5). The parties are forewarned that, once the Court approves any proposed discovery deadlines, it will thereafter be disincl ined to extend those deadlines. Plaintiff is further ORDERED to advise the Court, within 21 days of the date of this Order, as to how it intends to proceed against Defendant Mosaic Capital Group LLC.
