OPINION AND ORDER re: 37 MOTION for Summary Judgment . filed by Premier Contracting of New York, Inc. For the foregoing reasons, United's motion for summary judgment is GRANTED and Defendants Premier and Richs cross-motion for summary judgment is DENIED. Because the Court's resolution of the cross-motions for summary judgment renders moot Defendant Marlen Rodriguez's crossclaims, those crossclaims are dismissed. The Clerk of Court is directed to close the motion at Docket Number 37 and to close this case. (As further set forth in this Order.) (Signed by Judge J.
