OPINION AND ORDER re: 4 MOTION for Leave to Appeal filed by MF Global Holdings Ltd., MF Global Assigned Assets LLC. The Court therefore finds no exceptional circumstances justifying a departure from the basic policy of postponing appellat e review until after a final Judgment. The motion for leave to appeal is denied. Because the Court has denied the motion for leave to appeal, there need be no stay of arbitration pending resolution of that appeal, and plaintiff's motion for a stay is denied as moot.
