ORDER: On April 12, 2021, the United States Court of Appeals for the Second Circuit issued an opinion reversing this Court to the extent that it denied Defendant's motion to dismiss Plaintiffs Fifth Amendment Bivens claim. Dixon v. von Black ensee, No. 20-1651-pr (2d Cir. April 12, 2021.) Pursuant to the Second Circuit's opinion, Plaintiff's Fifth Amendment Bivens claim, the only remaining claim in this matter, is hereby dismissed. For the foregoing reasons, Defendant's motion for reconsideration is GRANTED in part and DENIED in part. It is granted only insofar as the Court will dismiss Plaintiff's First Amendment Bivens claim. Plaintiff's Fifth Amendment Bivens claim remains. The parties are directed to confer and submit a case management plan (attached) by May 11, 2020. OPINION AND ORDER re: 24 MOTION to Dismiss filed by Barbara Von Blackensee. For the foregoing reasons, Defendants' Motion to Dismiss is GRANTED in part and DENIED in part. All claims against Defendant Blackensee in her official c apacity are dismissed as a matter of law. All claims against Blackensee under Section 1983 are dismissed as a matter of law. All of Plaintiff's claims against Blackensee in her individual capacity under Bivens are dismissed except for Plaintiff& #039;s Fifth and First Amendment claim. Given that this is Plaintiff's second amended complaint, Plaintiff will not receive further opportunities to amend his complaint. The parties are directed to confer and submit a case management plan (attac hed) by July 12, 2019. The Clerk of the Court is respectfully directed to terminate the motion at ECF No. 24, mail a copy of this Opinion and Order to Plaintiff at his last address listed on ECF, and to show proof of service on the docket.
