Filing 37 MEMORANDUM AND OPINION re: 21 MOTION to Dismiss Pursuant to F.R.C.P. 12(b). filed by Mdim Rahaman, The City of New York. The City and Officer Rahaman now move, pursuant to Rule 12(b) of the Federal Rules of Civil Procedure, to di smiss Caldwell's claims. (Docket No. 21). Substantially for the reasons stated in their memorandum of law (Docket No. 24), that motion is GRANTED. For all of these reasons, Caldwell's claims must be and are dismissed as to all Defendants. The Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). The Clerk of Court is directed to terminate Docket No. 21, to close the case, and to mail a copy of this Memorandum Opinion and Order to Caldwell. (Signed by Judge Jesse M.
