Filing 137 ORDER granting 127 LETTER MOTION to Seal Document 126 Declaration in Opposition to Motion. Plaintiff seeks to file under seal certain exhibits submitted in connection with its oppositions to Defendants' motions for summary judgment. The Court grants Plaintiffs request as to AGA Exhibits 30 and 31, which appear to consist of "business information...which, if revealed, may provide valuable insights into [AGA's] current business practices that a competitor [might] seek to exploit." Louis Vuitton Malletier S.A. v. Sunny Merchandise Corp., 97 F. Supp. 3d 485,511 (S.D.N.Y. 2015) (citation omitted). Accordingly, Plaintiffs request for leave to file a redacted copy of Exhibit 30 on the docket and to file Exhibit 31 in its entirety under seal is granted. It is not clear to the Court, however, exactly which Newmont Exhibits Plaintiff seeks to file under seal. On the first page of this letter, Plaintiff lists Exhibits 83-84, 131-132, and 140-143. On the second page, Plaintiff discusses Exhibits 84-85, 132-133, and 141-144. The hard copies delivered to the Court are labeled Exhibits 83-84, 131-132, and 140-143, but the contents appear to relate to Exhibits 84-85, 132-133, and 141-144, as detailed in the Declaration of Gregory P. Szewczyk. No later than January 7, 2020, Plaintiff shall clarify which Newmont Exhibits it seeks to file under seal, and shall email the Court both a highlighted set and a clean, unredacted set of those exhibits. Chancellor, 21 MOTION to Dismiss Pursuant to Rule 12(b)(6) filed by AngloGold Ashanti USA Incorporated, Wayne M. Chancellor, AngloGold Ashanti Limited, AngloGold Ashanti North America, Inc. As explained above, AngloGold's motion to compel arbitration is granted and the case is stayed as to the Purchase Price Adjustment claim only; Chancellor's motion to dismiss for lack of personal jurisdiction is denied; and Defendants' motion to dismiss Newmont's claims relating to the purported third-party mineral interests in a plot of land on Victor Mining's property is granted. Plaintiff may amend the Complaint so long as it does so no later than October 18, 2018. As soon as practicable thereafter, and in no event later than October 25, 2018, the parties shall confer and su bmit to the Court a letter explaining how Defendants intend to respond to the amended complaint.
