For the foregoing reasons, CBOE's motion to dismiss is granted. In its opposition papers, Exceed appears to request further leave to amend, which is denied. None of the additional information offered by Exceed would remedy the defects fatal to its claims and accordingly any amendment would be futile. See Singh v. NYC Dist. Council of Carpenters Benefit Funds, No. 17-CV-7159 (VSB), 2018 WL 4335511, at *4 (S.D.N.Y. Sept. 11, 2018). The Clerk of Court is respectfully directed to terminate the motion pending at docket entries twelve and twenty-three, and to close the case. SO ORDERED.
