Filing 58 OPINION AND ORDER re: 51 FIRST MOTION for Judgment Final as to Defendant Madsen filed by Securities and Exchange Commission. For the foregoing reasons, the Court GRANTS the Commission's motion and imposes a "second-tier&qu ot; civil penalty on Madsen in the amount of $80,000. By separate Order to be entered today, the Court will direct the Clerk to enter final judgment consistent with this Opinion.
