OPINION AND ORDER GRANTING IN PART AND DENYING IN PART DEFENDANT'S MOTION TO DISMISS re: 19 MOTION to Dismiss Pursuant to Fed. R. Civ. P. 12(B)(6), filed by Microsoft Corporation. For the reasons stated herein, the motion to dismis s is granted in part and denied in part. Count I of the complaint is dismissed for failure to state a claim; Count II remains viable. The clerk is instructed to terminate the motion (ECF 19). The parties shall appear for a status conference on June 1, 2018 at 10:00 a.m., and as further set forth herein.
