OPINION & ORDER re: 41 MOTION to Dismiss the Amended Complaint. filed by T. Michael Riggs, Michael Testman, Jack Cooper Holdings Corp: For the foregoing reasons, Defendants' motion to dismiss is granted. The Complaint is dismi ssed with prejudice, as this Court previously informed River Birch during premotion proceedings that leave to replead would not be granted if Defendants prevailed on this motion.
