June 28, 2021 Opinion or Order Filing 127 MEMORANDUM DECISION AND ORDER for 124 Motion to Dismiss,, filed by 3-Eyed Optical, Inc., David Forest Gross, Fzoad.com Enterprises Inc., David Forrest Gross, Marina Kleyman, Frank Christian Fico, FZOAD.COM Enterprises, Inc., Manhattan Eyeworks, Inc., Triple Vision Corp., David Forrest Gross O.D., 126 Report and Recommendations. Before this Court is Magistrate Judge Ona T. Wang's May 5, 2021 Report and Recommendation (the "Report"), recommending that the motion to dismiss be granted. (Report, ECF No. 126, at 1.) Magistrate Judge Wang advised the parties that failure to file timely objections would constitute a waiver of those objections on appeal.(Id. at 8.) No objections have been filed. Having reviewed th e Report for clear error and finding none, this Court ADOPTS the Report in full. Magistrate Judge Wang's Report is ADOPTED. Defendants' motion to dismiss Plaintiff's complaint, (ECF No. 124), is GRANTED. The Clerk of Court is directed to close the motion and this case accordingly. (Signed by Judge George B. August 10, 2020 Opinion or Order Filing 118 ORDER: The Court is in receipt of the August 7, 2020 letter submitted by Frank Fico, Marina Kleyman, Manhattan Eyeworks, Inc., 3 Eyed Optical, Inc., and Triple Vision Corp (the "New Employer Defendants") referencing a January 2, 2020 l etter (ECF 111), which the Court will construe as a motion to dismiss the New Employers Defendants. (ECF 117). Plaintiff Richard Farmer is directed to submit a letter to the Court by August 24, 2020 with the following information: When and how th e New Employer Defendants were served. Plaintiff shall attach and file any affidavits of service in his possession. Plaintiff may email his response to Temporary_Pro_Se_Filing@nysd.uscourts.gov. See attached. Failure to respond may result in a recommendation of dismissal for failure to prosecute against these Defendants. The New Employer Defendants may respond within three (3) days after service of Plaintiff's letter. Counsel for the New Employer Defendants are directed to email a copy of this Order to the pro se Plaintiff, and file an affidavit of such service within three (3) days of this Order.
