Filing 19 MEMORANDUM OPINION AND ORDER re: 9 MOTION to Dismiss Amended Complaint filed by Lebron, David Jennings, Rodney Mitchell. For the foregoing reasons, Defendants' motion to dismiss is GRANTED. Plaintiff was on notice that declin ing to amend his pleadings to timely respond to Defendants' motion to dismiss could constitute a waiver of Plaintiff's right to use the amendment process to cure any defects that had been made apparent by Defendants' briefing. See Dkt. No. 11. Accordingly, the motion to dismiss is granted with prejudice. This resolves Docket Number 9. The Clerk of Court is respectfully requested to issue judgment and to close this case.
