Filing 24 MEMORANDUM ORDER granting 17 Motion to Dismiss. For the foregoing reasons, Defendants' motion to dismiss the Complaint is granted. This dismissal is without prejudice to the filing of a motion pursuant to Federal Rule of Civil Procedure 15 (a) for leave to amend the Complaint. Any such motion must be filed by October 12, 2018 and must be accompanied by a memorandum of law and a copy of the proposed amended complaint that is blacklined to identify the proposed changes. Failure to ma ke a timely motion for leave to amend, or to demonstrate in such a motion that amendment would not be futile, will result in dismissal of this action with prejudice and without further advance notice.
