May 10, 2021 Opinion or Order Filing 153 ORDER: On April 14, 2021, the Court granted New GM's motion for summary judgment on the claims brought by Tia Maynard and April Hollon on behalf of minor plaintiffs L.H., T.H., C.N., and R.N. Hancock v. Gen. Motors LLC (In re Gen. Motors LLC Ign ition Switch Litig.), Nos. 14-MD-2543 (JMF), 18-CV-1019 (JMF), 2021 WL 1415121 (S.D.N.Y. Apr. 14, 2021) (ECF No. 150).1 ThatMemorandum Opinion and Order directed Plaintiffs to "confer with New GM and, no later than [May 5, 2021], file redacted copies of ECF Nos. 135, 136, 137, and attachments - with redactions appropriately narrowly tailored in light of the foregoing principles - on ECF without viewing restrictions." Id. at *4. To date, Plaintiffs have not complied with their oblig ations. On May 7, 2021, New GM filed a letter indicating that the parties did meet and confer and that Plaintiffs had agreed to re-file their summary judgment papers without any redactions. ECF No. 152. As a courtesy, Plaintiffs' deadline to re -file the above-referenced papers with appropriately narrowly tailored redactions is hereby EXTENDED, nunc pro tunc, to May 17, 2021. January 4, 2021 Opinion or Order Filing 147 ORDER. Unless and until the Court orders otherwise, all deadlines are STAYED pending the Court's decision on New GM's motion. October 22, 2020 Opinion or Order Filing 129 ORDER. Several of the filings concerning the parties' cross-motions to enforce their settlement agreement remain temporarily under seal. See 18-CV-2590, ECF Nos. 68, 86, 93, 74, 88. On October 20, 2020, New GM filed a letter-brief addressing what materials should remain permanently sealed or redacted. See ECF Nos. 99, 100. In light of the Second Circuit's recognition of the importance of confidentiality with respect to the public interest in promoting settlement, see, e.g., Gambal e v. Deutsche Bank AG, 377 F.3d 133, 143 (2d Cir. 2004), the Court GRANTS New GM's application and agrees with the proposed redactions, substantially for the reasons stated in New GM's letter. Some of the materials at issue do not appear on the ECF system, as they were filed before the Court changed its procedures to enable filing of sealed documents on ECF. Other materials appear on the ECF system in unredacted form, but with restricted viewing access. To the extent that there a re materials that have not yet been filed on the ECF system, or which appear on the ECF system only in unredacted form with restricted viewing acces, New GM shall file them in a manner consistent with its proposal and this Order within one week f rom the date of this Order. Put differently, within one week from the date of this Order, New GM shall ensure that the public filings in this matter are consistent with its proposal and this Order. In addition, there are two documents, 18-CV-2590, ECF Nos. 89, 94, which are temporarily under seal, but which New GM does not address in its letter and for which New GM does not propose redactions, yet which appear to contain the kinds of information including sensitive information and settlem ent discussions that New GM argues, and the Court agrees, should remain permanently redacted. New GM shall therefore file redacted versions of those documents (consistent with its redactions to the other documents) within one week from the date of this Order. SO ORDERED. September 17, 2020 Opinion or Order Filing 122 ORDER: In light of the continuing dispute between New GM and Plaintiffs April Hollon and Tia Maynard as next friends of L.H., T.H., C.N., and R.N., (the "Hancock Plaintiffs") over the Hancock Plaintiffs' compliance with thei r discovery obligations under Order No. 25, 14-MD 2543, ECF No. 422; Order No. 108, 14-MD-2543, ECF No. 3115; and Order No. 148, 14-MD 2543, ECF No. 5366, as well as the Hancock Plaintiffs' intention to file a motion to request the rei nstatement of Plaintiff Megan Hancock and opposition to New GM's identification of their claims as barred by the statute of repose, 18-CV-1019, ECF No. 121, the parties shall appear for a conference before the Court on September 24, 2020 at 3:30 p.m. to discuss the path forward for this case. Counsel for both parties shall confer in advance with respect to how the Court should proceed given the various open issues.
