Filing 25 MEMORANDUM OPINION AND ORDER re: 24 MOTION to Set Aside 23 Order of Dismissal filed by Kieran Kelly. Finally, and in any event, Plaintiff has since refiled his claims. Under all the circumstances, the Court concludes that Plaintiff has fai led to meet Rule 60's high bar for exceptional relief. Plaintiff's motion is accordingly DENIED. The Court certifies, pursuant to Title 28, United States Code, Section 1915(a)(3), that any appeal from this Memorandum Opinion and Order woul d not be taken in good faith and, thus, in forma pauperis status is denied. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of Court is directed to terminate Docket No. 24 and to mail a copy of this Order to Plaintiff. SO ORDERED.
