Filing 34 OPINION AND ORDER re: 25 MOTION to Dismiss the Complaint. filed by City Of New York, Anthony Garvey, New York City Police Pension Fund Article II, New York City Police Department. For the reasons explained above, Defendants 9; motion to dismiss Velez's complaint is GRANTED without prejudice. If Velez wishes to file an amended complaint to attempt to cure the defects in his claims, Velez must move to do so by April 21, 2019, and he must attach to his motion a copy o f the proposed amended complaint. Failure to move to amend within the timeframe provided shall result in dismissal of Velez's claims with prejudice. The Clerk of Court is respectfully directed to terminate the motion, Doc. 25.
