The only claims that survive are the breach of subparagraph 1.5(d)(iii) and the related indemnification claim under subsection 7.2(b). The Clerk of Court is directed to terminate the motion at ECF Nos. 45 and 51. The parties shall appear before the Court for a pretrial conference on October 15, 2018, at 11:00 a.m. The parties are also directed to meet and confer and submit a proposed scheduling Order to the Court not later than one week before the conference.
