Defendants' moti on for summary judgment is granted as to all claims arising under the FLSA prior to March 7, 2015, and is otherwise denied. This Memorandum Opinion and Order resolves docket entry nos. 49 and 55. This case remains referred to Magistrate Judge Will is for general pretrial management. The parties must promptly contact Judge Willis' chambers to request a settlement conference and to address what, if any, pretrial matters remain outstanding if settlement of all outstanding issues cannot be achieved. August 8, 2019 Opinion or Order Filing 26 MEMORANDUM OPINION AND ORDER: re: 18 MOTION to Dismiss Defendant Old Heidelberg Corp.'s counterclaim filed by Danijel Mirkov, Bojana Novakovic, Uros Dukic, Andjela Stefanovic. For the foregoing reasons, Plaintiffs' motion to dismiss Defendants' counterclaim for failure to state a claim upon which relief can be granted is denied as to Plaintiff Danijel Mirkov, and granted as to Plaintiffs Andjela Stefanovic, Uros Dukic, and Bojana Novakovic. Defendants may move, within 21 d ays of the date of this Memorandum Opinion and Order, for leave to amend their Counterclaim to allege further facts regarding Plaintiffs Stefanovic, Dukic, and Novakovic. Any such motion must be accompanied by aproposed amended counterclaim, a blackl ine version of that proposed counterclaim identifying the changed language, and a memorandum of law. Failure to make such a timely motion will result in the dismissal of the counterclaim as against those three Plaintiffs with prejudice and without further advance notice. This Memorandum Opinion and Order resolves Docket Entry No. 18. The case remains referred to Magistrate Judge Fox for general pretrial management. SO ORDERED.
