Filing 111 CLERK'S RULE 54(B) JUDGMENT re: 110 Judgment in favor of Capitalcorp Limited, Capitalhold Limited, Shanda Games Limited, Danian Chen, Heng Wing Chan, Li Yao, Lijun Lin, Shaolin Liang, Yong Gui against Astor BK Realty Trust, David Monk. I t is, ORDERED, ADJUDGED AND DECREED: That for the reasons stated in the Court's Order dated November 29, 2022, judgment is entered in favor of the Dismissed Claims as to Defendants Shanda, Capitalcorp Limited, Capitalhold Limited, Li Yao, Lij un Lin, Heng Wing Chan, Yong Gui, Shaolin Liang, and Danian Chen. The judgment of the Dismissed Claims against the Dismissed Defendants is final pursuant to Federal Rule of Civil Procedure 54(b), there being no just reason for delay. All substanti ve proceedings in this Action before this Court are hereby stayed until the resolution of any appeal of the final judgments set forth above. Filing 103 OPINION AND ORDER re: 90 MOTION to Dismiss Second Amended Complaint for Failure to State a Claim Under Federal Rule of Civil Procedure 12(b)(6). filed by Shanda Games Limited, 95 MOTION to Dismiss Second Amended Complaint . filed by Capitalcorp Limited, Capitalhold Limited, Yingfeng Zhang. Defendants' motions to dismiss are hereby denied in part and granted in part. Count I (fraud) is dismissed under Rule 12(b)(6) for failure to plead loss causation. Acco rdingly, Count IV (fraud) is also dismissed because there is no primary violation to sustain a Section 20(a) claim for control personal liability. Counts II and III (insider trading) are dismissed against Defendants Shanda, Capitalcorp, and Capita lhold. The Clerk of Court is respectfully directed to terminate the motions at ECF Nos. 90 and 95 and to terminate Defendants Shanda, Capitalhold, and Capitalcorp from the case. Lead Plaintiff and the remaining defendants shall file a joint statu s report within 14 days informing the Court how they would like to proceed with this case.
