November 25, 2019 Opinion or Order Filing 91 ORDER OF DISCONTINUANCE: By letter dated November 22, 2019, the parties reported to the Court that they have reached a settlement in this case. Accordingly, it is hereby: ORDERED that this action be conditionally discontinued without prejudice and w ithout costs; provided, however, that within thirty (30) days of the date of this Order, the parties may submit to the Court their own Stipulation of Settlement and Dismissal for the Court to So Order. Otherwise, within such time Plaintiff may app ly by letter for restoration of the action to the active calendar of this Court in the event that the settlement is not consummated. Upon such application for reinstatement, the parties shall continue to be subject to the Court's jurisdiction , the Court shall promptly reinstate the action to its active docket, and the parties shall be directed to appear before the Court, without the necessity of additional process, on a date within ten (10) days of the application, to schedule remaining pretrial proceedings and/or dispositive motions, as appropriate. This Order shall be deemed a final discontinuance of the action with prejudice in the event that Plaintiff has not requested restoration of the case to the active calendar within such 30-day period. March 20, 2019 Opinion or Order Filing 68 OPINION & ORDER: For the reasons stated in this Opinion, Defendants' motion to dismiss is GRANTED in part and DENIED in part. Plaintiffs' claims based on the denial of a consistent paraprofessional and of testing accommodations are d ismissed for lack of subject matter jurisdiction, and, even were there jurisdiction, are dismissed for failure to state a claim. Plaintiffs' ADA and Rehabilitation Act claims based on failure to provide a modified disciplinary system are dismi ssed on the merits, as are Plaintiffs' ADA claims seeking monetary damages against the Individual Defendants. Plaintiffs' federal constitutional claims against the Institutional Defendants survive, while their federal constitutional claims against the Individual Defendants are dismissed with the exception of solely those claims against Defendant Inslee arising from post-September 15, 2017 alleged suspensions with insufficient process. Plaintiffs' related state law claims surviv e. Plaintiffs' remaining ADA and Rehabilitation Act claims for discrimination and retaliation survive. The Clerk of Court is directed to terminate the motion at docket entry 55. Per the Court's individual rules, the parties are ORDERED to meet and confer and submit a proposed case management plan to the Court on or before April 19, 2019.
