By Order dated 6/29/2020 (ECF No. 241), the Court granted an extension until 7/3/2020 for Hector De La Rosa to provide discovery responses. Due to his failure to provide such responses, he is in violation of a court order. If Mr. De La Rosa fails to provide discovery responses by 7/10/2020 and/or fails to appear for a deposition by the 7/17/2020 deadline (see ECF No. 217), I will recommend that his claims be dismissed for failure to prosecute. No later than 7/20/2020, the parties shall advise the Court whether Mr. De La Rosa has complied and/or appeared, so that the Court may make a Report and Recommendation as to Mr. De La Rosa, and also as to Claudia Vasquez Ibarra, who still appears on the ECF docket as a Plaintiff with pending claims. May 26, 2020 Opinion or Order Filing 198 ORDER granting in part and denying in part 195 Letter Motion for Discovery. The depositions of Nidia Perdomo, Alba Maria Mejia and Hector de la Rosa shall take place on Friday, May 29, 2020 commencing at 10:30 a.m. by remote means, whereby Defend ants' counsel can clearly see all deponents, and shall continue until completed. Furthermore, all depositions in this action may be taken via videoconference or other remote means and a deposition will be deemed to have taken place before an off icer appointed or designated under Rule 28 (see Fed. R. Civ. P. 30(b)(5)(A)) if such officer attends the deposition using the same remote means used to connect other participants, so long as all participants (including the officer) can clearly hear and be heard by all other participants. Finally, I will recommend that the the claims of opt-in Plaintiff Claudia Vasquez Ibarra be deemed withdrawn unless she appears for a deposition prior to June 1, 2020 or unless she makes an application showing good cause for failure to appear, no later than June 8, 2020. The Court conditionally certifies a class of all non-exempt employees (including, but not limited to, cooks, food preparers, dishwashers, porters, bussers, food runners, d elivery persons, counterpersons, helpers and wait staff) employed by each of the La Abundancia locations on or after April 12, 2012. The parties shall meet and confer as to the form of notice to be distributed and shall refer any disputes between the parties regarding the notice to the Court. The form of notice and any disputes relating thereto shall be submitted within seven days of the date of this Opinion and Order.
