Filing 48 OPINION AND ORDER re: 28 MOTION to Dismiss Second Amended Complaint; 36 FIRST MOTION to Dismiss; 34 MOTION to Dismiss: For the foregoing reasons, Donovan's motion to dismiss is GRANTED as to plaintiff's claims for n egligent infliction of emotional distress and violation of N.Y. Executive Law § 296(6), and otherwise DENIED. Granger's motion to dismiss is GRANTED as to plaintiff's claim for vicarious liability and otherwise DENIED. Plaintiff may pr oceed on Counts I, II, III, and VII, and on Count VI except with respect to claims for violations of N.Y. Executive Law § 296(6).
