Filing 55 OPINION AND ORDER: re: 46 MOTION to Dismiss Amended Complaint filed by Pete Butkowsky, Darrell Jenkins, John Desena, Quanta Services, Inc., Ashley Miller, Earl C. Austin, Jr., Phoenix Power Group, Inc., Tom Buchanan. For the foregoing reasons, Defendants' motion to dismiss for improper venue is DENIED. Defendants' motion to dismiss the claims against Defendant Austin is GRANTED. The remaining Defendants shall answer the Amended Complaint within 14 days of the date of this opinion and order.
