February 19, 2021 Opinion or Order Filing 87 MEMORANDUM AND ORDER: re: 69 MOTION to Amend/Correct First Amended Complaint filed by Giovanni Rodriguez. For the foregoing reasons, plaintiff's motion for leave to file an amended complaint is GRANTED in part and DENIED in part. The Court permits amendment to replace John Doe defendants throughout the complaint and denies the additions of the Procedural Due Process and Equal Protection Claims. The Court does not address the PSAC's amendments to the eleventh cause of actio n in light of plaintiff's withdrawal of this cause of action during oral argument. To the extent not addressed in the preceding Memorandum and Order, plaintiff's proposed amendments are permitted. Plaintiff is directed to file his Second Am ended Complaint consistent with this Memorandum and Order within seven days of its issuance.
