May 12, 2021 Opinion or Order Filing 180 ORDER: Trial in this case is scheduled to begin on May 19, 2021. Pursuant to Rule 43(a) of the Federal Rules of Civil Procedure, the recovery of a witness from a serious medical condition, compounded by the COVID-19 pandemic, constitutes a compel ling circumstance and provides good cause to allow the witness (the "Remote Witness") to provide testimony remotely via videoconference. Accordingly, after due deliberation, the Court is prepared to adopt the following virtual procedures which provide appropriate safeguards in relation to the remote testimony of the witness. Any party objecting to these procedures or who wishes to suggest alternate procedures shall do so by a letter submitted on ECF no later than Thursday, May 13, 2021. The Remote Witness shall provide testimony using the WebEx platform, which has been selected by the parties. The witness shall participate in appropriate pretrial technology testing no later than May 17, 2021 and as may be required by furthe r order of the Court. The parties shall prepare two binders for the Remote Witness. The first binder ("Binder One") shall be prepared by the party offering the witness. It shall contain all exhibits that the party offering that witness i ntends for the witness to discuss at trial. The second binder ("Binder Two") shall be prepared by the party opposing the witness. Binder Two shall contain all exhibits that the opposing party intends for the witness to view during cross- examination. By no later than May 17, 2021, copies of Binder Two shall be provided to the Remote Witness as well as to opposing counsel. They shall be sealed and they shall, on the exterior of the binders, clearly instruct the witness and opposing counsel not to open the binders until directed to do so. The Remote Witness and opposing counsel shall not review Binder Two until the cross-examination begins. A hard copy and USB drive of Binder One shall be provided to the Court on May 19, 2021. December 9, 2020 Opinion or Order Filing 153 ORDER granting 122 Letter Motion to Seal; granting 123 Motion in Limine; denying 124 Motion in Limine; granting 128 Letter Motion for Leave to File Document. On December 4, 2020, the Court held a final pretrial conference. At the conference, the Court discussed the parties' motions in limine. Dkt. Nos. 122-1, 124. For the reasons stated on the record, Plaintiff's motions in limine are denied. Defendant's first, second, and fourth motions in limine are d enied, while Defendant's third and fifth motions in limine are granted. Defendant's sixth motion in limine is granted in part and denied in partthe determination of the amount, but not the availability, of punitive damages, will be bifurcated into a second trial phase. Defendant is directed to write the Court by December 10, 2020 regarding Defendant's proposed procedure for adjudicating the second phase. The Court also addressed the parties' motions to seal. D kt. Nos. 122, 123, 128. For the reasons stated on the record, those motions are granted. Moreover, the Court granted Defendant's application for an adjournment of the trial date, contained in Defendant's opposition to Plaintiff& #039;s application for testimony of certain witnesses to be taken by remote means. Dkt. No. 150. The Court will set a new trial date by separate order. As stated on the record, the parties are directed to submit a joint letter to the C ourt by December 15, 2020 describing their positions regarding the temporal scope of this case and, if necessary, their proposed process for litigating that issue. October 23, 2020 Opinion or Order Filing 127 ORDER terminating 126 FIRST LETTER MOTION to Seal re: emailing in limine motion papers to the court. Because both redacted and unredacted versions of Plaintiff's motion in limine papers have been filed on ECF, Plaintiff should not email the motion papers to the Court. The Court expects that it will rule on the motion to seal shortly after it rules on Plaintiff's motions in limine. The Clerk of Court is directed to terminate the motion pending at Dkt.
