ORDER: On August 30, 2019, the Court received competing proposed revised case management plans from plaintiff and defendants. Dkts. 61, 62. The proposed plans appear to be identical except for Paragraphs 4-6. The Court adopts plaintiff's paragraph 4, Dkt 62-1 paragraph 4, which is more in line with the Court's expectations for initial disclosures following defendants' filing of an amended counterclaim, Dkt. 60. The Court adopts defendants' paragraphs 5 and 6, which allow for additional discovery relating to three specified fact witnesses, Dkt. 61-1 paragraph 6(c), and to the new allegations contained within defendants' amended counterclaim, id. paragraph 6(d). The parties are directed to file a joint Revised Civil Case Management Plan and Scheduling Order reflecting this Order by September 5, 2019. To the extent that a party perceives a need to conduct a specific additional fact deposition, as previewed by plaintiff's August 30, 2019-letter, the Court expects that the parties will meet and confer and attempt to agree on the scope of any additional deposition. OPINION & ORDER re: #32 MOTION for Judgment on the Pleadings: For the foregoing reasons, the Court grants PartnerRe's motion for judgment on the pleadings to the extent PartnerRe seeks dismissal of defendants' counterclaim. The dismissal is, however, without prejudice to defendants' right to rep lead, consistent with the parameters set in this decision. The Court respectfully requests that the Clerk of Court terminate the motion pending at Dkt. 32. In the event defendants intend to so file, such an amended counterclaim is due within 14 days of this decision. ORDER. On April 19, 2019, the parties filed competing proposed Case Management Plans. Dkts. 42-43. Disappointingly, and notwithstanding the Court's guidance in its order, the parties have been unable to agree as to a proposed Case Management Plan. Although both proposals envision the same deadline for the close of fact discovery, June 28, 2019, plaintiff proposes several interim discovery deadlines to which defendants do not consent. Plaintiff argues such interim deadlines are necessary to ensure that depositions are not delayed indefinitely. The Court approves, by contemporaneous order, the Case Management Plan proposed by defendants. That plan sets a fact discovery deadline of June 28, 2019, and, consistent with the Court's earlier order, allows the parties to "negotiate, within the fact period as extended, the time period within which depositions would occur." Dkt. 41 at 2. The Court does not intend to micromanage the parties' interim discovery deadlines. The Court is unpersuaded by plaintiff's concern that defendants may "seek to delay depositions indefinitely." Dkt. 43. The Court has stated its expectation that the parties conclude fact discovery-including depositions-within the fact discovery period as extended to June 28, 2019. The Court expects defendants to work with dispatch to complete document discovery such that the depositions may proceed. Finally, plaintiff's counsel writes "we are concerned that relations among counsel have evolved in a way that is not conducive to managing this case effectively without Court intervention. For this reason, as an alternative to or in addition to entry of Plaintiff's proposed order, Plaintiff respectfully requests that the Court consider appointing a Magistrate Judge to oversee discovery in this matter." Dkt. 43 at 2. This request is denied. The Court presently intends to resolve any discrete discovery disputes that arise between the parties. Notwithstanding the representation that relations between counsel "have evolved in a way that is not conductive to managing this case effectively without Court intervention," the Court expects counsel to work collegially and in good faith to resolve potential disputes and avoid burdening this Court, or a Magistrate Judge, with unnecessary discovery disputes.
