Filing 5 ORDER TO ANSWER, 28 U.S.C. 2255: The Court, having concluded that the motion brought under 28 U.S.C. 2255 should not be summarily dismissed as being without merit, hereby ORDERS that: The Clerk of Court shall electronically notify the Criminal Division of the U.S. Attorney's Office for the Southern District of New York that this order has been issued. Within sixty days of the date of this order, the U.S. Attorney's Office shall file an answer or other pleadings in response to the motion. Movant shall have thirty days from the date on which Movant is served with Respondent's answer to file a response. Absent further order, the motion will be considered fully submitted as of that date. Filing 4 ORDER DIRECTING ORIGINAL SIGNATURE: Movant America Massa brings this pro se motion under 28 U.S.C. 2255, but he failed to sign it. Rule 11(a) of the Federal Rules of Civil Procedure provides that "[e]very pleading, written motion, and other paper must be signed by at least one attorney of record in the attorney's name - or by a party personally if the party is unrepresented." Fed. R. Civ. P. 11 (a); see also Local Civil Rule 11.l(a). The Supreme Court has interpreted Rule ll(a) to require "as it did in John Hancock's day, a name handwritten (or a mark handplaced)." Becker v. Montgomery, 532 U.S. 757, 764 (2001). Because Movant failed to sign the motion, the Court directs that Movant sign a declaration indicating that he has read the motion and return the declaration to the Court within thirty days of the date of this order. The Clerk of Court is directed to mail a copy of this order to Movant and note service on the docket. No answer shall be required at this time. If Movant fails to comply with this order within the time allowed, the motion will be denied without prejudice. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. Cf Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that appellant demonstrates good faith when seeking review of a nonfrivolous issue). Signature Page due by 8/27/2018.
