Filing 8 VALENTIN ORDER: The Clerk of Court is directed to mail a copy of this order to Plaintiff, together with an information package. The Court dismisses Plaintiff's claims against "New York State, Department of Corrections," the State of New York, and his official-capacity claims against the individual defendants as frivolous and for seeking monetary relief from defendants that are immune from such relief. 28 U.S.C. 1915(e)(2)(B)(i), (iii). The Court also dismisses Plaintiff's remaining individual-capacity claims against Governor Andrew M. Cuomo without prejudice. The Court further dismisses Plaintiff's claims against the Woodbourne Correctional Facility for failure to state a claim on which relief may be granted. 1915(e)(2)(B)(ii). The Court denies Plaintiff's motion for the appointment of counsel without prejudice. (ECF No. 3.) The Clerk of Court is additionally directed to mail a copy of this order and the complaint to the Attorney General of the State of New York at 28 Liberty Street, New York, New York 10005. An amended complaint form is attached to this order. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. Cf Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). SO ORDERED. State of New York, Andrew M.
