ORDER: WHEREAS, for the reasons stated at the October 9, 2018, conference; it is hereby ORDERED that Defendant Buzzfeed's deadline to file a response to the Complaint is stayed pending a Court-ordered motion to dismiss briefing schedule. Defendant Buzzfeed shall file its contemplated pre-motion to dismiss letter in accordance with the Court's Individual Rule III.A by October 15, 2018. Plaintiff shall file its response letter by October 23, 2018. One of the parties shall include a joint proposed briefing schedule in their letter. There will be no pre-motion conference. CIVIL CASE MANAGEMENT PLAN AND SCHEDULING ORDER: All parties do not consent to conducting all further proceedings before a United States Magistrate Judge, including motions and trial. See 28 U.S.C. 636(c). All fact discovery shall be completed no later than 2/1/19. Depositions pursuant to Fed. R. Civ. P. 30, 31 shall be completed by 2/1/19. This is to be tried to a jury. Counsel for the parties have conferred and their present best estimate of the length of trial is 2-3 days.
