| Filing 4 STIPULATION: IT IS HEREBY STIPULATED AND AGREED by and between the undersigned parties, that: 1. Plaintiff hereby dismisses individual William L. Kuhn from this action, with prejudice and without costs to any party. Plaintiff will take whatever steps are necessary to effectuate such dismissal with the Court, including by filing any required documents. 2. Defendants will produce William L. Kuhn for a deposition, at a location and time to be determined. 3. Defendants will return signed waivers of service to Plaintiff on behalf of all remaining Defendants upon execution of this Stipulation. 4. All remaining Defendants will serve and file an answer to the Complaint on or before November 12, 2018, and will not move to dismiss the Complaint in lieu of filing an answer. 5. All remaining Defendants will not raise any defense of lack of service of process or of improper service of process with respect to the Complaint. (William L. Kuhn terminated.
