Date Filed Document Text
March 11, 2019 Opinion or Order Filing 15 CIVIL JUDGMENT: Pursuant to the order issued March 11, 2019, dismissing the complaint, IT IS ORDERED, ADJUDGED AND DECREED that the complaint is dismissed under 28 U.S.C. 1915(e)(2)(B)(ii). The Court declines under 28 U.S.C. 1367(c)(3) to exercise supplemental jurisdiction over any state law claims that Plaintiff may be asserting. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from the Courts judgment would not be taken in good faith. IT IS FURTHER ORDERED that the Clerk of Court mail a copy of this judgment to Plaintiff and note service on the docket. (Signed by Judge Colleen McMahon on 3/11/2019) (Attachments: #1 Appeal Package)(mro) Transmission to Docket Assistant Clerk for processing.
March 11, 2019 Opinion or Order Filing 14 ORDER OF DISMISSAL: By order dated January 8, 2019, the Court directed Plaintiff to file an amended complaint within sixty days. That order specified that failure to comply would result in dismissal of the complaint. Plaintiff has not filed an amended complaint and the time to do so has expired. Accordingly, the complaint, filed in forma pauperis pursuant to 28 U.S.C. 1915(a)(1), is dismissed under 28 U.S.C. 1915(e)(2)(B)(ii). The Court declines under 28 U.S.C. 1367(c)(3) to exercise supplemental jurisdiction over any state law claims that Plaintiff may be asserting. The Clerk of Court is directed to mail a copy of this order to Plaintiff and note service on the docket. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). (Signed by Judge Colleen McMahon on 3/11/2019) (mro) Transmission to Docket Assistant Clerk for processing.

January 8, 2019 Opinion or Order Filing 12 ORDER TO AMEND. The Clerk of Court is directed to assign this matter to my docket, mail a copy of this order to Plaintiff, and note service on the docket. Plaintiff is granted leave to file an amended complaint that complies with the standards set forth above. Plaintiff must submit the amended complaint to this Court's Pro Se Intake Unit within sixty days of the date of this order, caption the document as an "Amended Complaint," and label the document with docket number 18-CV-8242 (CM). An Amended Complaint form is attached to this order. No summons will issue at this time. If Plaintiff fails to comply within the time allowed, and she cannot show good cause to excuse such failure, the complaint will be dismissed for failure to state a claim upon which relief may be granted. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). SO ORDERED.
