May 28, 2019 Opinion or Order Filing 40 ORDER: On October 9, 2018, Petitioners brought an action to compel arbitration under the Federal Arbitration Act (the "FAA"). ECF No. 1. On December 4, 2018, Respondents moved to dismiss the petition. ECF No. 31. It is hereby ORDERED that by June 4, 2019, Petitioners shall file a supplemental brief, not to exceed five double-spaced pages, explaining their position on whether the Court can compel arbitration given that Respondents have appeared in the arbitration and, therefore, have not "refus[ed]" to arbitrate within the meaning of Section 4 of the FAA as interpreted by the Second Circuit. See 9 U.S.C. 4 ("A party aggrieved by the alleged failure, neglect, or refusal of another to arbitrate under a written agreement for arbitration may petition any United States district court...for an order directing that such arbitration proceed in the manner provided for in such agreement."); see also Downing v. Merrill Lynch, Pierce, Fenner & Smith, Inc., 725 F.2d 192, 195 (2d Cir. 1984) ("Unless [the respondent] commences litigation or is ordered to arbitrate this dispute...and fails to do so, it is not in default of any arbitration agreement it may have with [the petitioner].
