Filing 4 CIVIL JUDGMENT: Pursuant to the order issued October 15, 2018, dismissing the complaint, IT IS ORDERED, ADJUDGED, AND DECREED that the complaint is dismissed without prejudice pursuant to the August 25, 2008 order in Pickering-George v. City of New York Bronx Cnty., No. 08-CV-5112 (KMW) (S.D.N.Y. Aug. 25, 2008), app. dismissed, No. 08-5355-cv (2d Cir. May 1, 2009) (appeal dismissed as frivolous). The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from the Court's judgment would not be taken in good faith. IT IS FURTHER ORDERED that the Clerk of Court mail a copy of this judgment to Plaintiff and note service on the docket. (Signed by Judge Louis L. Stanton on 10/15/2018) (Attachments: #1 Appeal Package)(mro) Transmission to Docket Assistant Clerk for processing. |
Filing 3 ORDER OF DISMISSAL UNDER 28 U.S.C. 1651: On August 25, 2008, Plaintiff was barred from filing any new action in forma pauperis (IFP) without first obtaining from the Court leave to file. See Pickering-George v. City of New York Bronx Cnty., No. 08-CV-5112 (KMW) (S.D.N.Y. Aug. 25, 2008), app. dismissed, No. 08-5355-cv (2d Cir. May 1, 2009) (appeal dismissed as frivolous). Plaintiff files this new pro se case, seeks IFP status, and has not sought leave from the Court. This action is therefore dismissed without prejudice for Plaintiff's failure to comply with the August 25, 2008 order. The Clerk of Court is directed to assign this matter to my docket, mail a copy of this order to Plaintiff, and note service on the docket. The Court certifies, pursuant to 28 U.S.C. 1915(a)(3), that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). (Signed by Judge Louis L. Stanton on 10/15/2018) (mro) Transmission to Docket Assistant Clerk for processing. |
