Plaintiff's claims in the above-captioned action be and the same hereby arc discontinued without prejudice to Plaintiff commencing and filing an Action under Stale Law in New York State Supreme Court, and without wavier of any or Defendant's rights or defenses to any future action commenced in connection with this case, and without costs to either party as against the other.
