STIPULATION AND ORDER REGARDING DEADLINES FOR BANKRUPTCY APPEAL BRIEFS: 1. By and through the Order Scheduling Conference entered on November 20, 2018 (a copy of which is attached hereto as Exhibit A) (the "Bankruptcy Court Order"), the Honorable Mary Kay Vyskocil, U.S.B.J., ordered the interested parties in the underlying bankruptcy case to participate in a mandatory settlement conference on or before December 17, 2018. By agreement of counsel for the interested parties, including Appellant and Appellee, the settlement conference is currently scheduled for December 11, 2018. 2. By and through the Bankruptcy Court Order, Judge Vyskocil further scheduled a status conference in the bankruptcy case for December 20, 2018 (the "Bankruptcy Court Status Conference") and directed that "the Parties shall jointly communicate with the chambers of the Hon. Andrew L. Carter to advise the District Court that the Parties are engaging in settlement discussions under the supervision of the Bankruptcy Court and request that briefing in the appeal from the Settlement Order be held in abeyance pending the [Bankruptcy Court Status Conference]." 3. On November 30, 2018, on consent of all interested parties, the Bankruptcy Court Status Conference was adjourned from December 20, 2018 until January 16, 2019. 4. In accordance with the Bankruptcy Court Order, Appellant and Appellee hereby advise the District Court that the parties are engaging in settlement discussions under the supervision of the Bankruptcy Court and request that the briefing schedule in the above-captioned case and each of the two related cases be held in abeyance pending the Bankruptcy Court Status Conference. 5. Promptly after the Bankruptcy Court Status Conference, Appellant and Appellee will either: (1) notify the Court that the interested parties in the bankruptcy case have reached an agreement that alleviates the need to adjudicate the issues on appeal herein; or (2) submit a proposed schedule for the bankruptcy appeal briefs. 6. This Stipulation may be executed in counterparts and exchanged by facsimile or electronically with the same force and effect as if executed and exchanged in the original. SO ORDERED.
