November 13, 2018 Opinion or Order Filing 7 STIPULATION AND CONSENT ORDER: Plaintiff Judlau Contracting, Inc. ("Plaintiff") and Defendant Johnson Controls, Inc. ("Defendant") (collectively "the Parties") hereby stipulate and agree to the following: That the Parties' dispute, as alleged in Plaintiffs Complaint, ECF Doc. No. 1-1 (the "Dispute") is subject to and within the scope of the arbitration provision found in the purchase order attached to Plaintiff's Complaint (ECF Doc. No. 1-2, the "Arbitration Provision"); and That the Parties shall submit the Dispute to arbitration and shall proceed in accordance with the Arbitration Provision; and That, in accordance with the Federal Arbitration Act, 9 U.S.C. 1 et seq., and any other applicable law, the Parties jointly request that this Court STAY this litigation pending the Parties' completion of the arbitration proceedings described in Paragraph 2 above; and accordingly That this litigation is hereby STAYED pending the Parties' completion of arbitration proceedings; and as further set forth herein. The parties shall file a joint status report on April 1, 2019, and each July 1, October 1, and January 1 thereafter while the case remains on suspense. IT IS SO ORDERED.
