The Court dismisses Plaintiffs claims under 42 U.S.C. 1983 against all of the individual defendants in their official capacities, including all claims against Commissioner James P. O'Neill. The Court also dismisses Plaintiff's claims against the New York City Police Department. The Clerk of Court is further directed to mail a copy of this order and the complaint to the Corporation Counsel of the City of New York at 100 Church Street, New York, New York 10007. An amended complaint form is attached to this order. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
