This matter comes before the Court on the Plaintiffs Motion for Preliminary Injunction. This Court having reviewed the Motion for Preliminary Injunction, and the Parties hereby agreeing to the following preliminary relief, without prejudice to any and all rights, claims and defenses available to defendants in both law and equity, and being duly advised on the premises, orders as follows: New Street Enterprise, Inc. d/b/a Social Fix and Ossian Ventures, Inc., their members, officers, agents, licensees, servants, employees, attorneys and all other persons in active concert or participation with them, including but not limited to Teresa Tateossian, are preliminarily enjoined, through the date of a final judgment on the merits, from using, advertising, promoting, and/or claiming sponsorship and affiliation with the trademark THE UNICORN, UNICORN, UNICORN CROWDFUNDING, or any similar imitations in any manner, including but not limited to, in connection to entertainment services, namely, an ongoing series featuring challenges of raising capital by providing start-ups with access to a hard-to-reach influential global audience of professional investors provided through cable television; and as further set forth herein.
