Filing 3 ORDER TO ANSWER, 28 U.S.C. SECTION 2255: The Clerk of Court is directed to open a new civil action, James v. United States, with a new case number. The Clerk of Court is further directed to docket in the new case the following documents from Case No. 00-CV-8818 (LAP): ECF Nos. #8 ( 2255 motion), and #12 (memorandum of law). Within thirty days of the date of this order, Movant may file an amended 2255 motion or, in the alternative, submit a letter stating that he wishes to rely on what he has already filed (the motion and memorandum of law). Within thirty days of the date of Movant's submission, the U.S. Attorney's Office shall file an answer or other pleadings in response to the motion. Movant shall have thirty days from the date on which Movant is served with Respondent's answer to file a response. Absent further order, the motion will be considered fully submitted as of that date. All further papers filed or submitted for filing must include the criminal docket number and will be docketed in the criminal case. Movant's applications for counsel and for discovery, filed in 00-CV-8818, are denied without prejudice to renewal at a later date after the Court has had more of the relevant facts and legal issues presented to it for its consideration. The Clerk of Court is directed to terminate those motions. (ECF Nos. 9, 11.) The Clerk of Court shall electronically notify the Criminal Division of the U.S. Attorney's Office for the Southern District of New York that this order has been issued. The Clerk of Court shall mail a copy of this order to Movant at: Kent Adam James, #92530-071, FCI Hazelton, P.O. Box 5000, Bruceton Mills, W. Va. 26525, and note service on the docket.
