Filing 10 ORDER granting #7 Letter Motion to Stay; granting #9 Letter Motion to Continue. The Court hereby grants the City's motion and directs the City to file status updates every 30 days, beginning on Thursday, February 28, 2019, until the completion of the NYPD investigation. These updates, consistent with plaintiff's request, should apprise the Court of the status of the investigation and articulating the City's position regarding the continued necessity of the stay of this action. The Court, however, does not find it necessary for the City to provide an accompanying affidavit from the official in charge of the investigation. SO ORDERED. (Signed by Judge Paul A. Engelmayer on 1/29/2019) (ne) |

The Court has received defendants' letter motion to stay this action pending an ongoing investigation by the NYPD into the events underlying this lawsuit. See Dkt. 7. Defense counsel has helpfully set out its reasoning with case law in support of its motion. Defense counsel has also informed the Court that plaintiff does not consent to this motion. Before the Court rules on this motion, therefore, the Court invites plaintiff to file a letter, not to exceed three single-spaced pages, setting out its position. Plaintiff's letter is due Tuesday, January 29, 2019. SO ORDERED. (Signed by Judge Paul A. Engelmayer on 1/22/2019) (anc) |
