January 23, 2019 Opinion or Order Filing 13 STIPULATION REGARDING SECOND EXTENSION OF RELIEF PROVIDED IN THE COURT'S DECEMBER 6, 2018 ORDER AND ADJOURNMENT OF HEARING: IT IS HEREBY STIPULATED AND AGREED by the Commission, through undersigned counsel, and defendants Rajeshwar R. Gannamaneni, Deepthi Gandra, and Linga R. Gannamaneni, through their undersigned counsel, that all of the relief granted in the Order, including but not limited to the freeze of Defendants' United States assets, shall remain in full force and effect until April 9, 2019 at 1:59 p.m. or further ruling from the Court. IT IS FURTHER AGREED that the date and time for Defendants to appear and show cause, if there be any, why the Court should not enter a preliminary injunction extending the asset freeze and other relief set forth in the Order until a final adjudication on the merits shall be adjourned until April 5, 2019 at 2 p.m. or such other time and date set by the Court. IT IS FURTHER AGREED that the deadline for Defendants to respond to any expedited discovery demands propounded by the Commission pursuant to Section V of the Order is extended until March 7, 2019 at 5 p.m. IT IS FURTHER AGREED that the deadline for Defendants to deliver any opposing papers pursuant to Section VII of the Order is extended until March 21, 2019 at 5 p.m. IT IS FURTHER AGREED that the deadline for the Commission to file any reply papers pursuant to Section VII of the Order is extended until March 28, 2019. IT IS FURTHER AGREED that by entering into this stipulation, Defendants do not wave, and specifically preserve, any defenses that arise under Rule 12(b) of the Federal Rules of Civil Procedure, including but not limited any defense based on lack of personal jurisdiction. IT IS FURTHER AGREED that this Stipulation may be signed in counterparts by facsimile or electronic signature, and that such facsimile or electronic signature shall be deemed an original signature for purposes of this Stipulation.
