January 31, 2019 Opinion or Order Filing 18 ORDER TO SHOW CAUSE: ORDERED that Defendant FMC SERVICES, INC. appear to show cause before a motion term of this Court, in Courtroom 618, United States Courthouse, 40 Foley Square, in the City, County and State of New York, on Tuesday, February 26, 2019, at 5:00 p.m., or as soon thereafter as counsel may be heard, why a judgment of default should not be entered pursuant to Rule 55 of the Federal Rules of Civil Procedure against that Defendant, in the amount of $10,054.00 in delinquent benefit contributions, along with interest in the amount of $4,288.15, and liquidated damages in the amount of $2,010.80, attorney's fees in the amount of $1,462.50, and costs of $598.00 for a total judgment of $18,413.45 plus interest at the statutory rate in effect on the date of judgment. It is further ORDERED that service of a copy of this ORDER TO SHOW CAUSE and annexed affirmation and exhibits upon the Defendants on or before 5:00 p.m. on Thursday, February 7, 2019, (1) by way of certified mail at their last known place of business at 630 Churchmans Road, No. 106, Newark, Delaware 19702, and (2) by personal service of FMC Services Inc. through the Delaware Secretary of State, shall be deemed good and sufficient service; and it is further ORDERED that any opposition by Defendants be filed with this Court on or before 5:00 p.m. on Monday, February 18, 2019; and it is further ORDERED that any reply papers by Plaintiffs be filed with this Court on or before 5:00 p.m. on Monday, February 25, 2019; and it is further ORDERED that the Defendants are advised that failure to respond to the Order to Show Cause may be grounds for the granting of a default judgment against them, in which event the defendants will have no trial; and it is further ORDERED that the Plaintiffs shall file proof of service of this Order to Show Cause by February 8, 2019; courtesy copies of all papers shall be sent to Chambers on the same day they are filed.
