STIPULATION: It is now STIPULATED AND AGREED that Plaintiffs shall withdraw their cause of action asse1ted under Title IX with prejudice. The Plaintiffs further stipulate that they will not assert any claims under Federal Law in this action or this action after it has been remanded to State Court. Accordingly, IT IS FURTHER STIPULATED AND AGREED that, as there are no Federal causes of action that remain in the Verified Complaint or the Verified Bill of Particulars, and Plaintiffs will not seek to assert any Federal causes of action, this matter is remanded to the New York State Supreme Court, Westchester County, where only the New York State Law causes of action shall be asserted. The Defendant does not waive any available defenses as asserted in its Answer to the Verified Complaint. SO ORDERED. (Signed by Judge George B.
