Filing 5 BANKRUPTCY APPEAL SCHEDULING ORDER: The above-captioned bankruptcy appeal has been assigned to me for all purposes. The appeal was docketed in the District Court on New York on January 9, 2019. Counsel and/or the parties are directed to review and comply with the Court's Individual Rules and Procedures ("Individual Rules") (available at the Court's website, http://nysd.uscourts.gov/judge/Schofield) to the extent they are not inconsistent with the Federal Rules of Bankruptcy Procedures ("FRBP"). FRBP Rule 8006 requires the appellant to file "a designation of the items to be included in the record on appeal and a statement of the issues to be presented." FRBP Rule 8009 provides the dates within which briefs are to be served and filed. Among other requirements, the Rule provides that appellant shall serve and file a brief within 14 days after entry of the appeal on the docket. Dates for appellee briefs, reply briefs and briefs on cross appeals are set forth in the Rule. The filing of briefs is not excused in this case. The time limits set forth in Rule 8009 are adopted as the Order of this Court. When the reply is served, the appellant shall provide Chambers with a courtesy copy of the briefs as directed in the Court's Individual Rule III.B.6, as well as the order and opinion on appeal. At the same time, appellant shall provide Chambers with a copy, either on paper or in digital form, of the items included in the record on appeal. Paper copies shall be doubled-sided, three-hole punched, tabbed, indexed and placed in binders. Digital copies shall be submitted on a CD in PDF format, and bookmarked or indexed so that individual items can be readily located. Any request for an extension or adjournment shall be made only by letter as provided in Individual Rule I.B.2 and must be received at least 48 hours before the deadline that is the subject of the request. Failure to comply with this order and/or the time limits in Rules 8006 or 8009 will result in dismissal of the appeal (in the case of the appellant) or consideration of the appeal without an appellee's brief (in the case of the appellee).
