April 17, 2019 Mailed a copy of #12 Order, Add and Terminate Parties, to Kelechi Ogidi JID No: 248455 Westchester County Jail 10 Woods Road P.O. Box 10 Valhalla, NY 10595. (vba)
April 16, 2019 Opinion or Order Filing 12 ORDER. The Clerk of Court is directed to assign this matter to my docket, mail a copy of this order to Plaintiffs, and note service on the docket. The Court severs Plaintiffs' claims from each other under Fed. R. Civ. P. 21. Kelechi Ogidi will proceed as the sole plaintiff in this action. The Clerk of Court is further directed to open separate civil actions with new docket numbers for David Smith and Tasjawn White. A copy of the complaint, other documents in this case, and this order should be docketed in each new case. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that appellant demonstrates good faith when seeking review of a nonfrivolous issue). SO ORDERED. David Smith and Tasjawn White terminated. (Signed by Judge Colleen McMahon on 4/16/2019) (rjm) Transmission to Docket Assistant Clerk for processing.
