November 20, 2019 Opinion or Order Filing 31 ORDER: IT IS HEREBY ORDERED THAT all previously scheduled conferences and other deadlines are CANCELLED. IT IS FURTHER ORDERED that this case is DISMISSED with prejudice and without costs (including attorneys' fees) to either party. The Clerk of Court is respectfully directed to terminate all open motions and to CLOSE the case. Within 30 days of this order, the parties may apply to reopen this case. Any such application must show good cause for holding the case open in light of the parties' settlement and must be filed within 30 days. Any request filed after 30 days or without a showing of good cause may be denied solely on that basis. Additionally, if the parties wish for the Court to retain jurisdiction to enforce their settlement agreement, they must submit within the same 30-day period: (1) their settlement agreement to the Court in accordance with Rule 6.A of the Court's Individual Practices and (2)a request that the Court issue an order expressly retaining jurisdiction to enforce the settlement agreement. ENDORSEMENT: Given Mr. Leibowitz's repeated failure to abide by this Court's orders, the Court declines to take Mr. Leibowitz's conclusory statements at face-value. No later than July 26, 2019, Mr. Leibowitz must explain in detail, how the purported "administrative oversight" occurred. He must name all individual(s) responsible for the oversight and describe, in detail, how the oversight occurred, why that oversight was not discovered and rectified for months, and what processes Mr. Leibowitz has installed to prevent future non-compliance with this Court's orders. Given his pattern of non-compliance across numerous cases, Mr. Leibowitz is further on notice that the Court may consider any future non-compliance as part of a pattern of reckless or willful disregard of this Court's orders, rather than mere negligence. July 11, 2019 Opinion or Order Filing 23 MEDIATION REFERRAL ORDER AND ORDER TO SHOW CAUSE: IT IS HEREBY ORDERED that, in light of Defendant's recent appearance in this case, that Plaintiff's request for a default is DENIED. The parties are once again referred to the Mediation Office to facilitate potential settlement under Local Civil Rule 83.9. The parties are hereby notified that Local Rule 83.9 shall govern the mediation, and the parties are directed to participate in the mediation in good faith. No later than one week after the conclusion of all mediation in this case, the parties are directed to notify the Court whether they successfully resolved the case in mediation. The Court specifically requests that a mediator with expertise in copyright matters be assigned. IT IS FURTHER ORDERED that Mr. Richard Liebowitz must show cause, no later than July 18, 2019, why he should not be sanctioned $500, apart from the suspended sanction in Dvir, for failure to comply with this Court's Mediation Referral Order, dated February 28, 2019, which required him to file proof of service within three days of effectuating service. February 28, 2019 Opinion or Order Filing 8 MEDIATION REFERRAL ORDER: This case, involving claims under the Copyright Act, 17 U.S.C. 101 et seq., has been assigned to this Court for all purposes. In the Court's experience, cases involving copyright claims often benefit from early mediation. To that end, prior to a Rule 16(b) case management conference, the Court is referring this case to the Mediation Office for settlement purposes under Local Civil Rule 83.9. The parties are hereby notified that Local Rule 83.9 shall govern the mediation, and the parties are directed to participate in the mediation in good faith. No later than one week after the conclusion of all mediation in this case, the parties are directed to notify the Court whether they successfully resolved the case in mediation. The Court specifically requests that a mediator with expertise in copyright matters be assigned. To facilitate prompt mediation, the Court ORDERS Plaintiff: to file proof of service no more than three days after service has been effected; and to produce to Defendant, by the earlier of 1) 14 days after service of process or 2) three business days in advance of any mediation session, copies of records sufficient to show the royalty paid the last three times the picture that is at issue in this case was licensed, as well as the number of times the picture was licensed in the last five years.
