October 30, 2019 Opinion or Order Filing 29 ORDER denying without prejudice to renewal #20 Letter Motion for Conference. WHEREAS, on September 26, 2019, Defendant filed a pre-motion letter and supporting affidavit seeking to move to dismiss pursuant to Fed. R. Civ. P. 12(b)(1) on the grounds that Defendant's website is now in compliance under the Americans with Disabilities Act; WHEREAS, on October 18, 2019, Plaintiff filed a letter and supporting affidavit in response, asserting that the website remains non-complaint. It is hereby ORDERED that, on December 16, 2019, at 10:30 a.m. an evidentiary hearing will be held to determine whether any accessibility barriers on the website remain. It is further ORDERED that, if either party intends to rely on expert testimony at the forthcoming hearing, the party shall file its expert report by November 19, 2019, regarding whether there are any accessibility barriers on the website. By November 26, 2019, the parties shall file simultaneous letter briefs regarding the court's subject matter jurisdiction in the event there are no remaining accessibility barriers. Plaintiff is reminded that he has the burden of establishing that there is subject matter jurisdiction. It is further ORDERED that Defendant's letter motion to file a motion to dismiss (Dkt. No. 20) is DENIED without prejudice to renew following the resolution of the evidentiary hearing.
